Feed The Birds….

Last summer I commented after seeing Wes Anderson’s Moonrise Kingdom about what a watershed year was 1965 for the death of innocence and the death of traditional America.   Mary Poppins was about as innocent and pure a story as anything could be, as was Julie Andrews’ portrayal of the fabled Nanny.   The reality of the world was that it had already changed, of course—I was living in London and had an Indian-born Nanny, for example, whose legacy to me was a lifelong fondness for curry.   But in that day and age it was socially acceptable to be Christian, and to think of St. Paul’s Cathedral building during the Restoration (Charles II) as the center of the city and invoke the concept of the living Saints and Apostles looking down on the people.  Even my Indian Nanny was fine with all that.  She was probably more of an Anglophile than half the members of the BNP are today, as well as a Church of England communicant.  Of course, what’s amazing is that even the Beetles and Ed Sullivan Show seem astoundingly traditional and innocent by comparison with the modern world.   Pop culture was trying to reaffirm our Anglo-European heritage back then, not destroy it.  Now the media are trying to convince us that everyone who lived back then was psycho….

“American Horror Story, Asylum” is a new television series decidedly dedicated to the notion that the America of the 1950s and 1960s was a dangerous, psychotic place dominated by evil religious nuts and Nazi escapees……

Confessions of a Lifelong-Heroine Addict….(oh well, since I was 6 or 8 I guess, probably not so much before that…)…from Dorothy Gale to Katniss Everdeen

The California Secretary of State having quite literally locked the doors to my running for Senate this year (at least in Tulare and Fresno Counties)—and the California Courts not seeming to offer a sufficient or accessible remedy—I now have time to indulge other (if related) obsessions my life, such as my sufferings from a lifetime of heroine addiction….  

Like almost every other aspect of my life, I blame my mother Alice and grandmother Helen almost equally….

It was my mother and father who, when I was very small, used to take me down by the Thames in Westminster near the Houses of Parliament and show me the statue of Bodice, the Iceni Queen of East Anglia who rebelled and died trying to evict the Roman Conquerors, in whose memory it was said and sung that “Britons never shall be slaves.”  We also took one trip out to Norwich to visit one of the woods where the Iceni supposedly worshipped their own goddess of Victory….called “Budika” in the Ancient British language of the Druids….(my parents were both heavily into historical and comparative linguistics).  Budika/Boadicea in A.D. 60-61 apparently burned Roman Londinium to the ground along with several other cities before being defeated and poisoning herself by the long Roman Road called “Watling Street” which we also visited…. She was a heroine and supposedly a great archer….  

Of course my parents also tried, as heart as their own agitated and addled lives would permit them, to make me aware of a very different heroine, regarding whom they required me to memorize “the Magnificat” from a very early age….”My soul doth magnify the Lord….Abraham and his seed forever…” And yes, the Virgin Mary was indeed a rebellious heroine… and she has remained a heroine to hundreds of millions of people up to the present time….

But it was my grandmother Helen who was something of a heroine in my young eyes herself, and it was Helen who introduced me to the very first literary  (as distinct from Historical or Biblical) heroines of whose stories I ever learned in detail: namely Dorothy Gale, Scarlett O’Hara, and the Roman Goddess Diana and her Sacred Temple by Lake Nemi  near Ariccia (Diana was also an archer…)

The path of fictional heroines from Dorothy Gale’s grey home in Kansas to Katniss* Everdeen’s equally grey home in District 12 of Panem took 108 years….from the first publication of the Wizard of Oz in 1900 through the appearance of archer Katniss Everdeen  Hunger Games in 2008**….is really the history of the idealistic dreams and ultimate failure of the 20th century (idealist dreams in Baum’s time giving way to a more cynical realism by 1939, passing through the somewhat confused “liberation” of the 1960s, sinking into the dark, pessimistic world of Buffy and Angel and finally coming to rest in the despair of District 12 in Panem in 2008—the year Barack Hussein Obama took over from George W. Bush…two different faces for the heartless, soulless, President Snow….)

But the difference in spirit between those two places traces indeed the tragic story of the Decline and Fall of Western Civilization (and of the American Dream) in the 20th Century. Major stopping points along the way (for me at least) include 1939 with the Dorothy Gale’s transformation in the person of Judy Garland and Scarlett O’Hara’s complete redefinition of the concept of “progress” in the late 19th century, Jane Fonda’s comic Cat Ballou and Barbarella in the 1960s, and Buffy the Vampire Slayer in movie and television from 1992-2003.  

At each of these intervals, the world is more cynical and darker, and the heroines more complex.  Many critics have observed that the “head injury/dream sequence” aspects of the 1939 Movie Wizard of Oz and the metathesis of real individuals to “dreamtime” residents of the Land of Oz (which was COMPLETELY absent from L. Frank Baum’s book) resulted directly from Freudian psychoanalysis and the early popularity of psychology.  The general effect is to radically weaken the power of Oz as metaphor or lesson—but the movie was a wonderful hit—a lightly comic Wagnerian gesammtkunstwerk of acting, visual art, and music, so nobody really cared.  

A lot of the verbal banter and humor in the movie likewise showed a certain “worldly” sophistication with which I think Frank Baum would only have been somewhat congenial. E.G. the Cowardly Lion’s song “there’s just no use denyin’, I’m just a DANDYlion…” and the Wizard’s closing comment to the Scarecrow:

Back where I come from we have universities, seats of great learning -- where men go to become great thinkers. And when they come out, they think deep thoughts -- and with no more brains than you have.... But! They have one thing you haven't got! A diploma!

As a former denizen of the great academic Halls of Cambridge, Massachusetts 02138 and Chicago 60637, and a regular visitor to many other such places, I can tell you that the Wizard here is absolutely right: 

And when they come out, they think deep thoughts -- and with no more  brains than you have.... 

But such cynicism simply was not part of the original vision of Oz, and although Baum occasionally did occasionally turn such comments to ridicule life back in North America in later books, he did not at all in his first installment in which he remade European folk mythology and archetypes and reshaped them in a very idealized panorama of a world where death was rare if non-existent and even the most evil of men and creatures did not kill for sport or pleasure.

For all of L. Frank Baum’s futuristic visions, I do not think he could have foreseen the transition from the naïve and hardworking life of Kansas to the nightmarish dreamworld of Suzanne Collins’ grim opera—neither a soap opera nor a very lyric, although even in the written version (which I finally got around to reading), music plays an immensely important part in the methathesis of metaphor and character, from Katniss’ Father to Peeta, from Prim to Rue… as between the unnatural National Anthem of the Conquering Capitol and the free world of nature and the poor of the “outlying districts.”

L. Frank Baum’s Oz books in so many was shaped and defined the culture of early-to-mid 20th Century of a predominantly White Christian America, especially after the release of Judy Garland’s movie….***  The spirit of Dorothy Gale’s Kansas was stiflingly dull and harsh—the American dream had already, at that point, apparently kind of run aground and needed new life— The spirit of Dorothy Gale’s Oz was half atavistic throwback to the Middle Ages, half filled with futuristic wonders (such as Glinda the Good’s Magic Picture, which permitted her what we would now call “live video access” to whatever was going on in Oz or elsewhere earth she was interested.

Dorothy Gale was a simple, pre-teenage girl (Judy Garland was at least ten years older than the original character was portrayed as being in the First Oz Book, but Dorothy Gale remained essentially a-sexual throughout the series, never had a boyfriend or a beau…. perhaps recapitulating some archaic notion of “the Virgin Goddess”,  e.g. Diana Nemorensis or the Virgin Mary or the “Virgin Queen”, Mary again or Queen Elizabeth I) whose strength derived from common sense, great courage, love, and determination.  Dorothy Gale was a generalist who never specialized in anything or focused on any particular trade, profession, or way of earning a living (all throughout the long series of Oz books, in fact).  She was just flexible, imaginative, and practical—kind of a “Renaissance girl” in a very low tech way.

Being a non-specialized generalist seems to be the primary role of all feminine heroes.  Of the earliest three I knew (Dorothy Gale, Scarlett O’Hara, and Diana Nemorensis), if Dorothy Gale had the purest and most asexual identity, Scarlett O’Hara surely had the most impure and sexual.  

It was perhaps for that reason that I was never really taken with her until I was a teenager, even though with my grandparents I religiously had watched Gone with the Wind at every possible opportunity and my grandmother compared the mythic South with the real South over and over again.   Scarlett O’Hara was beautiful, flirtations, and OWNED men in a way that is both fairly realistic and quite cynical.  But the book and movie Gone with the Wind were brilliantly timed between the First and Second World Wars to show that the American War Between the States of 1861-1865 was the first really and truly modern war of total destruction.  

Throughout history, up until Abraham Lincoln loosed Sherman on Georgia and Grant on Virginia, the goal of Conquest Warfare had been to preserve as much of a conquered land’s wealth as possible—so that it could be stolen and appropriated for the victors.  There might have been a lot of talk in Ancient Rome about how “Carthage must be destroyed” and about Salting the Earth once it was vanquished, but Carthage was not only not burnt to the ground and left to rot by the Roman Conquest, it became one of the Great Cities of the Roman Empire, as 20-30 years of Harvard Archaeological excavations in Tunisia have so clearly shown.  Gone with the Wind showed something else when Sherman’s “wind blew through Georgia.”  The purpose was indeed, as the opening lines of both the movie and the book suggested, to wipe out an entire civilization, a way of life—to replace what Marxists call one “mode of production” with another.   NONE of Baum’s villains in Oz were as bad as that, although the movie version of the Wicked Witch of the West was pretty murderous in her general attitude….

One major innovation of Jane Fonda’s heroines Cat Ballou and especially Barbarella in the 1960s was the advent of “free love”, which never appeared even once in any of Baum’s pre-1920 writings, which was only very obliquely alluded to in Gone with the Wind, but which by the 1960s was all anyone really cared about.  

Like Dorothy Gale and Scarlett O’Hara before her, Cat Ballou and Barbarella were unspecialized generalists who could adapt to almost any situation.  They were strong, intelligent, sexy, deadly in a good cause, and then Jane Fonda went to Hanoi….  In retrospect she may have been right to do it because the Vietnam War was totally wrong, a seriously failed experiment in 1984-type “perpetual war”….but Jane Fonda’s actions did not seem positive at the time.  

In this defiance of the outward semblance of world order sense, Jane Fonda’s characters of both Cat Ballou and Barbarella somehow came to life as defiant outlaws….crossing boundaries that no one else would cross, and doing so with both impunity and (what seemed most shocking at the time) complete immunity from real official sanction.  Like the righteous killer Catherine Ballou who avenged her father’s death in the Wild West—Jane Fonda first enacted herself as a mythic reality and then, by going to Hanoi, remade herself as a historic metaphor—walking through the image of a treacherous act, unscathed, in essence to show that Vietnam was all a staged event….. a dramatic diversion to keep the masses simultaneously afraid, amused and absorbed….  

Fast forward 24 years from Jane Fonda as Barbarella and you arrive the first incarnation of Buffy the Vampire Slayer, a completely modern LA County San Fernando Valley girl with no hints of modesty or virginity about her…. followed by the much more intriguing evolution of Buffy Summers in the TV Series from virginal high school freshman to intensely sexual college freshman, in a world which is increasingly dark and where reality is increasingly concealed….. Buffy’s Sunnydale was a mythic place, a lot like Los Angeles, while her first boyfriend and lover Angel eventually goes to the real Los Angeles and sets up shop as first as a private detective and then director of a large law firm—two professions which, in Los Angeles at least, possibly in the movies generally, have almost acquired the status of modern Jungian archetypes….  

The increasingly dark and brooding, sad and depressed Buffy Summers never lost her general adaptability—she could never specialize in any profession or line of work any more than Dorothy Gale or Scarlett O’Hara or Catherine Ballou… but the realization that the dark forces of the world were effectively unbeatable and had pre-existed anything good in the world—these were major transformations of the American Dream from the Early 20th Century.  And it was during the 7 televised seasons of Buffy that the 20th Century, which came in with a little girl magically transported by a tornado from dull grey Kansas to a bright and beautiful alternative universe which knew no death, went out during Buffy’s Freshman year at UCLA with a young adult barely out of her teens who was alone in the world, with her small circle of more specialized friends, fighting vampires and the forces of darkness.

And five years after Buffy ended, Katniss Everdeen picked up the bow from her archetypal ancestors the Goddesses Inanna and Diana and Queen Boadicea, and began to hunt for meagre food in the desperately hunger fringes of District 12 (in what was once called Appalachia in what was once called North America).  

The gruesomeness of the Hunger Games apparently shocks some people—I would have thought that Americans had long since forgotten how to be shocked about or by anything.  Children murdering children for sport isn’t the most pleasant of ideas, to be sure. But in that 17-19 year olds have gone off to fight in every war America has ever seen….along with a few 16 year olds here and there, and since the History Channel periodically shows authentic news clips of 15-16 year old resistance “werewolves” in 1945 Post-World War II Germany being shot by firing squads of American Troops, and countless tens of thousands of teenagers have been silently snuffed in Afghanistan, Iraq, and Vietnam, it is hard to believe that the idea of children fighting and dying is really such a big deal to our ever hypocritically squeamish population.

The Hunger Games resonate with so much in our history and culture—with the original Victor Hugo version of Les Miserables (hopelessly buried and lost in the Broadway Musical of the same name), and in Suzanne Collins’ own account with the myth of Theseus and the Minotaur.  

But above all the Hunger Games resonates with the year 2012 in which America has taken so many steps towards being a brutal, repressive dictatorship like Panem, already—with idiot fake and fraudulent “Conservatives” like Lindsey Graham and Newt Gingrich competing with idiot truly fraudulent “Liberals” like Carl Levin, Barbara Boxer, Dianne Feinstein, Nancy Pelosi, and Barack Obama competing with one another to see who can shred the Constitution fastest.  

Interesting to me, given that I based my own doctoral dissertation at Harvard in large part on revisiting Frazer’s the Golden Bough and with it Diana’s Temple by Lake Nemi near Ariccia, are the parallels between the Hunger Games and the myths and rituals of Divine Kingship.  There is nothing in the story of Theseus and the Minotaur, however, about games or about Tributes being well-fed and allowed every luxury leading up to their deaths.  But precisely this treatment is common in the rites of Divine Kingship, where sacrificial victims, like the individual selected for sacrifice during the rites of Toxcatl among the Aztec, are equated with the God Tezcatlipoca (“Smoking Mirror”) during the last year of their lives, given wonderful food and drink, and then sacrificed.  Similar paradigms of sacrifice are found throughout the world—

And the sacrifice of children, likewise, is extremely common: to the rain gods in Mesoamerica, relic traces of this existed even among the modern Yucatec Maya who tie small children to the legs of the altar during the cha-chaac or rain ceremony—although the children have to do nothing more that happily chirp like rainy season frogs (but woe to the boy who croaks like a dry season Toad—he will be beaten, not sacrificed, but beaten).  The Hebrew Bible itself is filled with child sacrifice (all through the Books of Kings and Chronicles, in particular, are Kings who make their children “walk through the fire”—perhaps most famously the daughter of Jeptha…), and by way of archaeological parallel—the excavations at Carthage have revealed hundreds and thousands of child sacrifices…. Among the Natchez of Mississippi, families sacrificed their children in order to rise in social status from commoners (“Stinkards”) to “Honored” Nobility according to the French records by Dupratz and recounted by John R. Swanton….

And in this sense it is perplexing: sacrifice almost always lead either to elevation in status or to outright deification: why the elite of Panem would not have recognized the risk embodied in Golden Bough-Divine Kingship type of analysis: the sacrificial victim—like the Rex Nemorensis at Ariccia who becomes King by killing the old one in combat, will always become the next king.  

At the end of the first book of Suzanne Collins’ trilogy, Katniss Everdeen is poised to become (with Peeta), Queen and King of Panem.  This was not only foreseeable, it was in comparative mythological terms inevitable—and yet Suzanne Collins’ trilogy does not allow this drama to evolve that way.  In part, this may be because technology and traditions of oppression have obliterated the natural succession of Divine Kingship….

But Sir James G. Frazer’s point in writing the Golden Bough was to show that Divine Kingship involving the deification of sacrificial victims and their elevation as Kings is a nearly world-wide phenomenon.  I sit here puzzling at the significance of all the trappings of Divine Kingship and the Golden Bough in the Hunger Games.  

Frank Baum had either borrowed or unconsciously recreated so many motifs from ancient mythology—the Four World Quarters with colors Winkie-yellow Quadlin-red Munchkin-blue and Gillikin-purple with Green for the Center of the Emerald City are like nothing so much as the mythological and symbolic organization of (1) Ancient Mesopotamia, “Land of the Four Quarters” centered on Uruk, (2) Celtic Ireland, Ulster, Munster, Connaught, Leinster, and centered on Midhe (Meath) at Tara, and (3) pre-Hispanic Yucatan which, at several Classic sites, is divided into quarters dominated (as recorded on Stelae A & H at Copan) by Tikal, Calakmul, Palenque, and Copan and which even now is divided into four quarters (Yucatán, Campeche, Quintana Roo, and Petén, with Belize claimed by Guatemala and Geographically appearing to be a southern extension of Quintana Roo).

But in Frank Baum’s Oz, kingship is never strong and is always frowned upon, as are all attempts at centralization or standardization of culture, customs, or laws among the four/five regions of Oz.  For that reason, I would assume, there are no hints or traces of divine kingship in Oz—it is a Federal egalitarian Democracy of sorts (even though no one ever votes).  

But by the time of Buffy, as the 20th century closes, the need for a leader has brought forward the Slayer—”one girl in all the world” who fights the Demons.  Now Joss Whedon optimistically ended his series with a devolution of power and prowess from Buffy through the magic of Willow to Millions of “potential” slayers—-but it didn’t quite ring true, in a Television series where even the most outrageous vampiric and magic witchcraft was somehow made to feel “emotionally authentic.”

In the Hunger Games, Dictatorship is the reality and the two victors of the Hunger Games, Katniss & Peeta, are set to become the Divine Kings and possibly the real sovereigns of their land.  Perhaps the need for leadership, the need for someone to save the population, is not yet great enough, but in terms of the political and emotional significance of our story-telling, I think that the journey from Dorothy Gale’s Grey Kansas to Katniss Everdeen’s Grey District 12 tells us the story of the loss of hope and impending doom and despair which was the 20th Century.

*  Katniss is named after a plant called Sagittaria, and my grandmother was born under the sign of Sagittarius—it could be that Katniss reminds me a great deal of my grandmother Helen—similar complexions and faces…. Actress Jennifer Lawrence certainly fits very precisely the image in Suzanne Collins’ book…. and the younger pictures I’ve seen of my grandmother with long hair as a teenager in the time before the U.S. entered WWI….growing up in a place very much like the defeated districts of Panem in the Southern USA.

** In some New Age texts, 108 years is said to be a Venus Cycle, the more ordinary astrological cycle is one of 104 years.  108 is used, but oddly enough, is four years longer than longest calendrical cycle and planetary identity of the Ancient Goddess of Love, namely Inanna/ Ishtar/Aphrodite/Venus.  The calendrical cycles of Venus and the sun are said to “bind” (i.e coincide) every 2920 days, but the ultimate binding of 5 Heliacal Cycles of Venus with 8 Calendar years …. (365 x 8 = 5 x 584 = 2920 x 13 = 37,960 = 2 x 52 years (my current age) = 104 calendar years/105 “tuns” or 360 day periods—the root of the Maya and Aztec Calendars).  Like her Roman Counterpart Diana, Aphrodite and Inanna were both archers—it seems to be the feminine weapon of choice, possibly for purely sexual Freudian reasons, possibly for some mixture of Freudian sexual and Jungian archetypal causation.

*** In the 1970s, Broadway Musical and 1978 movie “the Wiz” the just recently departed Diana Ross and the late Michael Jackson did their best to reframe and appropriate the Baum story for African-America in the aftermath of the Civil Rights movement (or Fraudulent Civil Rights Fiasco) of the 1950s-60s…. I have never been comfortable Easing on Down the Road with them in that direction…. although my grandfather was a great supporter of alternative all black productions (now almost extinct) because they upheld and even developed, really and truly, the old segregationist’s doctrine of Separate but Equal (we actually attended the Wiz at the Majestic Theater on Broadway as well as an all black revival of Guys & Dolls in my one major summer with him (ever in my life) in 1976.

Bob, like I said—I respect you a great deal, we’ve done some great things/seminars together and I hope we’ll do more in the future—I consider you a friend, if terribly blind on this point….

First, I don’t believe you understand IQ tests, for you you did, you would know that in the past 100 years they have evolved to become absolutely the best predictor of the ability to evaluate relative importances, solve problems, and achieve academic excellence.  
What I see and understand about IQ tests is that they are a circular argument, a Catch-22, a self-fulfilling prophecy.  Certain specialists designed IQ Tests, persuaded other specialists to rely on them, and since these specialists rely on them, the USE them, and discriminate among people according to such tests.  ALL Standardized tests work EXACTLY the same way: SAT, MCAT, GRE, LSAT, etc.—yes, even the Multistate Bar Exam and the Multistate Ethics exam—CLASSICAL EDUCATION IN THE US HAS BEEN REPLACED BY TEACHING TEST-TAKING SKILLS.  I think it is disgraceful, and that all standardized tests need to be thrown in the garbage—”the rubbish pit of history” to use one K. Marx’ catchy phrase….
You seem loathe to admit that, but for the protection and support of government and society, the stupid would perish or become slaves, as they have down through the millennia, not because of race, but because of cognitive ability.
No, I am NOT “loathe to admit” anything—but I read the record differently: GOVERNMENT and SOCIETY decide who is stupid, and for those who really can’t adapt—natural selection works MUCH more fairly than “Government Protection and Support.”  In fact–what I LOATHE is that very phrase: “Government Protection and Support.”  I don’t know whether you’ve seen the movie “The Hunger Games” yet—but if not you (and everybody else) really should.  
“The Hunger Games” is a story set in and about the aftermath of a revolution in North America of the future in which “the people rose up against the Government that fed them, loved them, protected them….” and were punished severely as a result.  LOOK AT THE WAY Southerners have been degraded and caricatured as stupid ignorant oafs since 1865.  The Post-War Southerners did JUST FINE for many years without government Protection and Support—in fact, they did fine IN THE FACE OF government oppression and intentional discrimination—arguably, they did better than they’ve done WITH such protection and support.  Likewise, all of Latin America and Africa were “undeveloped” by U.S. and European Colonialism which sought to protect these “poor pathetic people” from themselves—i.e. since they couldn’t organize multi-national companies and international banks on their own.  The people of District 12 grew strong through quiet resistance and isolation within Panem (the name of the “North American Union” in the “Hunger Games” were “protected and supported” by a totalitarian regime which existed by squeezing everything they could out of the people and leaving them with nothing).  
Third, you seemed to have missed the point that we of competence have become slaves to the incompetent, through welfare, minimum wages, crime, and associated infrastructure costs which we must pay.  That has happened largely because of flaws in the constitutions, gnawing guilt and political correctness, and suffrage for the stupid, incompetent, and irresponsible.
BOB—YOU seem to miss the point that it is precisely a paternalistic attitude like yours—whereby some people THINK they are stronger or better than others, that breeds this kind of stupidity in Welfare—we have to stop thinking that WE KNOW better or can make OTHER people better—we have to learn to live by the adage “Let it be.”  NO ONE has the right to make decisions for anyone else, except by agreement.  We do not have the right to classify people in LEGAL terms, deprive them of rights, based on our OPINIONS of them.  We have the right to live our own lives and not be bothered with anyone else UNLESS WE WISH TO BE—and this, I think is the biggest single reason I feel I have to argue for you.  You are SO much like Madison Grant and the “Progressives” of Theodore Roosevelt’s Age—like Oliver Wendell Holmes on the Supreme Court writing in favor of sterilization of imbeciles in the 1920s—THESE ARE THE PEOPLE WHO GAVE RISE TO THE CURRENT WELFARE STATE—even though the “gnawing guilt and political correctness” elements are basically a 1960s Herbert Marcuse—Frankfurt School of Social Though addition which the Elite Find EVEN more useful—precisely because it gives them the right to call people who are NOT politically correct or do not feel the guilt “stupid, inferior.”  Southern Whites are stupid hicks but racists everywhere have lower IQs than non-racists, didn’t you know that?  Patriotic Constitutionalists are the stupidest people of all because they just don’t understand the Marxist progression of history which will PROTECT AND SUPPORT all people everywhere…. Can’t you see that?  Christians are stupid compared with Atheists, Conservative Republicans have less education than Liberal Democrats—all of this is part of the competitive instinct of humans, inherited through evolutionary competition, as E.O. Wilson has described so well in “The Social Conquest of Earth”
Fourth, you have erred in your assessment of slavery in ancient times.  The foreign survivors of successful wars always became slaves for life, although laws provided ways to win freedom, typically by demonstrations of deserving freedom.
I have certainly NOT erred in my assessment of slavery in ancient times—I said it was not based on inherited characteristics, so that Angles enslaved in one war did not give rise to any presumption that “Angles” would be slaves forever.
Fifth, you seem not to grok the outcome of a system such as what I propose.  
I do not “grok” it because I would BLOCK it with every bone in my body, every fibre in my muscles, every neuron in my brain.

  • And, we can refer to masters/slaves by different terms to mollify the leftist liberals seeking political correctness in place of substance.  We could call it the Ward system and the participants caregivers/wards.  How’s that?
    You forget that I perfectly see the system of involuntary servitude you propose because I OPPOSE THE VERY NOTION OF WELFARE and that ANY person should ever be WARD to another as a matter of birth, “intelligence” or class.  If our parents develop alzheimers WE should take care of them—they should not become “Wards of the State”—our children are helpless at birth but even LESS should we allow THEM to become WARDS OF THE STATE—but ultimately, your system (based on early 20th Century Eugenic Theories) LEADS INEXORABLY to the wardship of all children and RIGHT BACK TO THE BRAVE NEW WORLD.  This has NOTHING to do with Political Correctness—it has EVERYTHING to do with restoring MEANINGFUL FUNDAMENTAL FREEDOM FOR ALL—and protecting MY Second Amendment Right to Shoot anyone in the head who thinks they are smarter than me if that means they think they can take me for a WARD….by the way…
  • Government or private parties could encourage the stupid to undergo voluntary permanent sterilization, just by offering money.  The ranks of the stupid would diminish dramatically from that clever negotiation, repeated in communities all over the nation.  And from the viewpoint of the economy, it would dramatically reduce the burden on taxpayers.  That bit of eugenics does not hurt anyone. 
  • Again, Bob—this is just beyond repugnant to me—it is Progressivism and New Deal/Great Society Socialism run amok—that is why it is, in essence NAZIISM at its worst….. Taxes like the Income Tax ONLY exist because people are WILLING to have OTHERS make socially important decisions for them—I say, to HELL WITH THAT—Everyone makes their own decisions and lives or dies by them…. that’s freedom….
  • Government should outlaw procreation of the stupid because such procreation is such a tort against the innocent baby that it becomes a crime against the person and society as the child grows into adulthood and resorts to crime and welfare abuse to subsist.  This really is a legal matter and a matter of right.  A baby has a right to grow into a well-functioning adult, and parents have the responsibility to make that possible.
  • If this is really what you want—I will have to fight you if you ever come to power—which I guess means we’ll never have to fight—but “outlaw the procreation of the stupid?”  This is EXACTLY what Oliver Wendell Holmes was advocating, along with Madison Grant and others, in the first 3rd of the 20th century—YOU have no right to say who should procreate and neither do I, and neither did Oliver Wendell Holmes or Madison Grant or either of the Presidents Roosevelt.  I think this is just loathsome—and I wonder about it–because I think of your niece—I can’t remember her name—in your own family there are examples of what can be called less than brilliant breeding, are there not?  You would not begrudge your own flesh and blood the right to procreate as she sees fit, would you?
  • Families of means, including middle class families, could typically afford to house, feed, and clothe the stupid, so long as those stupid did not procreate children the caregivers did not want.  Many if not most homes have extra bedrooms to accommodate live-in Wards who could become loved, respected members of the family, perform services for the family, and submit to the discipline of the head of the household.  Most so-called slaves prior to the 1860′s were really NOT slaves in the sense of wearing chains, getting horsewhipped and served only gruel to eat, and suffering untreated diseases and illnesses. Nor would modern Wards suffer such abuse.  The spirit of love would blossom in most families with one or more live-in Wards.  This alone would keep many Wards out of crime, malnutrition, prison, drug abuse, and general dereliction.
  • You are saying something very different in this paragraph and I have no wish to disagree that “charity is our first obligation” and civilized people and as Christians, and that such charity, if enshrined as a real cultural norm, would go a long way towards solving all these problems. 

Churches could start playing a big role in the administration of the Ward system, which they should have all along.

Again, this is something I have no intention of arguing about—but it is irrelevant to your contentions regarding the 13th Amendment….or “the belief that they can make people better…AND I DO NOT HOLD TO THAT.”  

As for eugenics, it is nothing more than family planning on a larger scale, and it is perfectly ethical.  In fact NOT to engage in eugenics plans and programs is the height of hyocrisy and disrespect toward the members of future civilizations.  If you want me to explain it to you in detail, let me know.  Meanwhile, ponder the adage “It takes seven generations to create a gentleman.”  It does not happen by accident.

Benjamin, and the all Founders of the Confederate States of America represent real, genuine, honest and truly American “Classical Liberal” conservatism.  AND NONE of them would ever have tolerated Eugenics—because it is an interference with the fundamental rights of individuals and families.
And that brings up an interesting point—you are advocating REPEAL or REVISION of the 13th Amendment in order to implement Eugenics?
Now, I just said I deeply admire and support the memory of the founders of the Confederate States of America, and the Southern Partisans who preceded them, but Slavery and Freedom are, by definition, incompatible lifestyles.  The 13th Amendment was adopted without the popular support of the 40% of the Nation who had no real vote in 1865, and yet today it is one of the least controversial provisions of the Constitution, and I think it needs to stay that way, and be enforced for every person.
I agree that the citizenship questions created by emancipation and left unresolved as of today are a threat to a homogeneous society in which freedom can flourish, but I totally disagree that slavery on any pretext, including the criminal laws of the United States, or Eugenics through anything as totally malleable and manipulable as IQ scores, could or should be allowed to exist.  In my opinion, segregation of the races might be a better path to restoration of true freedom and dignity for all, as well as a more natural path to foster divergent evolutionary paths which could, in the long run, compete my old Harvard neighbor and Museum of Comparative Zoology Professor E.O. Black Slavery was, in so many ways, America’s “original sin”—every student of the Bible knows that “original sin” is that in which we all share, as human beings, from which none of us can ever completely escape except through Salvation.  Original Sin is “sin” because it embodies and reflects everything that we need, everything that we want, naturally, and yet it is wrong.  People WANT to live free of care, fear, labor and all kinds of responsibility, which they would like to dump on someone else’s broader shoulders.  The Africans were naturally strong and by selective breeding in slavery they were made stronger.  Was this a good or desirable result for the White People?  For the White Race as a whole?  As an evolutionary experiment?  No, it was not. It was in fact a disaster—a continuing disaster.
But Bob—what you are suggesting is that we use IQ tests, one of the results of the “Original Sin” of Slavery having been to artificially import and then depress the intelligence of the Africans and other groups by educational intent, and then solidify that back into history by restoring IQ as a substitute for skin color in the restoration of slavery.
This is, I think, wrong in every possible way.  I do not believe that miscegenation is the road to happiness or a cure for the original sin of slavery, because I think that race-mixing destroys the natural diversity of the species—which I think is a GOOD and POSITIVE thing—even if it results in some people SEEMING dumber, less intelligent, or attractive to us than others.  We need to MAINTAIN the diversity of the world AND the freedom of each individual by securing individual and family autonomy, not slavery.
In the Ancient World (Rome & Greece), Slavery was almost always a temporary thing, by contract (arising from debt), and there were no permanent slave classes.  Slaves were often extraordinarily talented artists, cooks, musicians, actors/dancers, or even poets, and Slaves often tutored their masters’ children.  Even when Rome brought in captive armies or whole communities as slaves, these communities did not stay enslaved forever, from generation to generation. (I think of the comment about the Angles [Ancestors of the English] whose appearance was so beautiful on the Streets of Rome that Pope Gregory the I said, “non Angli see Angeli” and promptly dispatched as missionary the future Saint Augustine of Canterbury to preach to the Kentish Angles as well as the South and Eastern Saxons of Sussex and Essex—the point being that there was no pretense that the Angles would be a hereditary class of slaves forever).
But worst of all, I think your criteria for selecting a “slave” vs. a “free” class are more subject, and hence more unfair than even the Nazis could devise.  It is normally fairly clear, after all, who is Black or White, who is Jewish or Christian by birth or heritage.  
But in what I can only call an adoration of pseudo-science, you equate IQ and wealth with class and entitlement.  This, too, is appalling.  All IQ tests have been shown to be matters of learned behavior—”nurture not nature”, and so education would be the solution for that, except that compulsory education is itself a form of governmental interference with the absolute freedom into which all living beings and creatures are born.
I believe that people have to be free to make choices, good and bad, just like genetic mutations, some of which are beneficial, some of which are not, but most of which are simply neutral.
NO GROUP OF HUMANS has the God-like capacity or the God-like right to try to guide evolution or the “re-creation” of the human species.
I don’t know whether you ever saw the movie Serenity directed and produced by Joss Whedon (whose latest creation is the new Avengers), but Captain Malcolm Reynolds of the “Good ShipSerenity” (a “Firefly” Class Spaceship) engages in the following key monologue, after the discovery of what had really happened to the people of Miranda—who were poisoned by Government experiments in “behavioral improvement” based on similar pseudo-science:

Pesky Questions About Bozos

Does a society have the right to enact laws that effectively prevent members of the society from
  • becoming a financial burden on the rest of society?
  • endangering others in society?
  • infecting innocent babies with a condition of lifelong obtuseness, brutishness, torpidity, and lack of intelligence?
How and why has the USA changed in average intelligence since its beginning?
Does any right of a society or civilization justify limiting the lower boundary of intelligence for parenting, such as through eugenics programs?
This commentary addresses those questions and might provide insights for the sincere truth-seeker.

Law and Likelihood of Harming Others

Consider the legislative enactments regulating business practices, highway traffic, and human relations. Take for example seatbelt laws. Government requires people to buckle themselves in because:
  • People often cause car crashes through negligence, incompetence, judgment error, or equipment failure;
  • The violence of car crashes often maim or kill people in and out of the car;
  • Such terrible loss causes families to suffer from reduced of earning power and enjoyment of life, and becoming a burden on society;
Thus, modern civilizations prohibit human actions likely to endanger selves. others, and society.

Qualities and Uses of Intelligence in Civilization

According to Wikipedia’s IQ article, IQ has high heritability, intgelligence highly correlates to SAT scores, and people with IQ of 70 to 90 will likely engage in criminal behavior. Lynn and Vanhanen’s books on IQ show the high correlation of national average IQ to gross national product. Therefore, means exist for society to determine the intelligence (g factor) and IQ of its members, and their corresponding value to society in terms of productivity, academic achievement, likely crimnality, burden on society, and the likelihood of low-intelligence parents procreating low-intelligence children.
One must have an IQ of at least 85 to graduate from high school. US IQ distributions from actual tests reveal that at least 75 million of its people have IQ below 85 and even more cannot graduate from high school because of behavior and health problems associated with low intelligence.
In the past 150 years the US has moved away from circumstances requiring massive numbers of low-intelligence people in its military and work forces. The military leaders of today desperately want recruits to have high school diplomas, and many manual labor jobs have moved to 3rd world countries as mechanization has modernized farms and factories. America needs people who can think, arrive at correct evaluations, and make correct decisions.

Hypocrisy of Ignoring the Gene Pool

Wouldn’t it make sense to reduce the need for protective laws, prisons, and welfare infrastructures legislating to elevate the quality of the gene pool?
I see the refusal to take such action as rank hypocrisy:
  • We demand laws regulating seatbelt usage, road, motor vehicle, and building construction, highway speed, driver licenses, professions like plumbing, dentistry, medicine, and lawyering, and many other areas of life, on the basis of likelihood of resultant injury. But,
  • We ignore the far higher likelihood of injury resulting from procreation by people of low intelligence.
How much sense does that make?
Hypocrisy aside, does it not seem unintelligent to refuse to discuss the reasons and means for reducing the percentage of grossly unintelligent people in future populations? Does it not seem even more stupid to refuse out of political correctness – the notion of feeling embarrassed that the topic might offend those of grossly low intelligence?
How about taking a poll of the stupid and ask them whether they enjoy feeling confused, frustrated, victimized, in trouble, and unable to learn, to figure things out, or to make prudent decisions? We might discover that they think they figure things out just fine, or that they hate the condition and would become smart if they could.
Well, aside from that, it could go without saying that the highly intelligent would find some tasks boring that the lowly intelligent would find gratifying. Likewise, tasks that would challenge and gratify the intelligent would frustrate and anger the unintelligent.
Many jobs exist that would suit the unintelligent. Thus, society’s needs for the unintelligent still exist, such as domestic servitude, and simple tasks for which employers cannot afford machines. But such tasks have an economic value nonetheless, and it makes no economic sense to force an employer to pay more than the value of them.

Intelligence Strata (Classes) in America

The existence of 75 million relatively unintelligent people in America and the lack of available jobs for such people poses a serious problem that has resulted in America’s prisons bursting at the seams.
America has entered an age where it handles unintelligent people as follows:
  • Puts them into the welfare system (they burden taxpayers); and
  • Suffers crimes at their hands (they burden their victims and then the criminal justice system).
Meanwhile, the very smart have advertised the American Dream’s cornucopia of goods and services which the unwealthy obtain through debt. The unwealthy, unlike the unintelligent, do have intelligence, but either don’t use it sufficiently to become wealthy, or actually don’t have quite enough intelligence to become wealthy. That is, wealth does not generally happen by accident except when inherited by someone who very likely has high intelligence, the offspring of someone intelligent enough to garner wealth.
So we have three major strata:
  • The highly intelligent wealthy (high class)
  • The somewhat intelligent or lazy unwealthy (middle class)
  • The unintelligent poor (low class)
In practice:
  • The high class has managed to make the middle class into voluntary servants through glitzy ads and debt.
  • Many of the high and middle class employ the low class for domestic servants.
  • Some, but not that many, of the middle and high classes provide the low class with food, clothing, and shelter as part of the domestic servitude arrangement.
  • The existence of many if not most of the low class have made the high and middle classes into their involuntary servants through crime, and taxation that pays for welfare abuse, health care, social workers, failed education efforts, and prisons.
  • Even though taxes on the high class do pay for the upkeep of the low class, the high class never notices it as a burden because of other tax benefits and shelters, but those taxes impose a severe burden on the middle class.

The 13th Amendment and Reverse Slavery

This makes it apparent that the 13th Amendment did not actually abolish involuntary servitude. In reality, it appears that Americans, through their misguided sense of fairness, justice, and altruism, have destroyed the effectiveness of community charity programs for the feckless, handing those to government, and converted the middle class into slaves of the low class AND the high class.
The upshot of this weird dilemma: Americans have upset the Law of the Survival of the Fittest with a system of legislated slavery of the middle class to the high class through usurious debt and to the low class through taxation. Victims of this system can only imagine that the high class engineered it intentionally. It does seem pretty slick when one ponders it. And that explanation clarifies the reason Government refuses to patrol the borders or impose some kind of check on the presently unrestrained procreation of children by unintelligent parents.
This dilemma and its causes constitute a wholly immoral, unethical perversion of civilization’s ideals. A society ought to engineer civilization for evolution toward some age of light and life, so to speak, where no crime, poverty, or war exists, and people can prosecute their ambitions without unduly burdening their fellows. That can never happen in an increasingly mechanized society in which 25% of the people haven’t the cognitive ability to graduate from high school, and will certainly resort largely to crime or welfare abuse to get by.
People of low intelligence make sense in a free society so long as others don’t become systematic slaves to them. The unintelligent must have a means of becoming gainfully, self-sufficiently, and happily employed, or the wards of those willing to care for and obtain economic benefits from them. The unintelligent simply cannot become and remain wards of the state without an economic justification. Liberty, after all, comes at the expense of commensurate responsibility.

Reverse Slavery Justifies 13th Amendment Revision

The foregoing discussion sheds new light on the 13th Amendment. That Amendment should stand, but ONLY for people with sufficient IQ and ambition to operate self-sufficiently. So, Congress ought to modify it a bit to that end.
Though many might feel loathe to admit it, involuntary servitude gave many benefits to many people, in spite of members of master and slave classes abusing one another.

Potential Benefits of 13th Amendment Revision

It provided sustenance, employment, and regulation for the servants and labor and other economic and personal benefits for the masters. Both sides benefited and to a large extent enjoyed the arrangement. And most of the servants, though slaves, escaped far worse conditions in their homelands.
But, involuntary servitude had serious deficiencies:
  • Incorrigible and violent slaves endangered the master and other slaves, and belonged in prison, not in a family or commercial enterprise.
  • Abusive or negligent masters hurt or deprived their slaves.
  • Many people became slaves who had the intelligence and raw ability become good, self-sufficient citizens, and should not have become involuntary servants.
Today we have a reverse-slavery system where the high and middle classes, who can care for themselves and become good citizens, have become involuntary servants to the low class who cannot care for themselves or become good citizens.
Society must reverse this situation while dramatically reducing the low class to a size that society actually needs for a smoothly functioning economy. That constitutes the supreme reason to outlaw production of bozos in America. Within 3 generations the averate intelligence of the nation will rise significantly, welfare will diminish so that neighborhoods can handle it without government interference, crime will drop dramatically, inner city ghettos will disappear, prison industries will shrink, and America will become monumentally more productive, more competitive than ever in the world economy.
And, Americans with good sense should demand a change to the 13th Amendment to impose a system of involuntary servitude on able-bodied people who, by their nature, cannot or will not care for themselves without hurting or burdening others.
Americans of good sense will otherwise remain slaves to the unintelligent of the land. And that just doesn’t make much sense, does it?

April 13: The Hunger Games, Judicial Immunity, and the Dawn of a New Dark Age

Life in its petty pace from day-to-day (and related notes on why I’m not on the California ballot)

Is it a coincidence that the California Secretary of State refused to approve me for a ballot place as candidate for the United States Senate Seat currently held by Diane Feinstein within 3 days of Facebook Canceling my profile because I was “promoting or organizing violence?”  Since I have never (to the best of my knowledge) advocated (much less “organized”) violence except to praise the spirit of continuing revolution, it was a great shock to me, but that was how my Spring season began.  (My long-time personal assistant and “Man Friday” Peyton assures me that I’ve never organized anything in my life, violent, peaceful, or indifferent)  

The snafu that led to my ballot position not being approved may yet prove the subject of a lawsuit, so I shan’t go into details except to say: California’s “Top Two, Voter Nominated” primary system only makes sense if non-professional political operatives (i.e. “voters”) are actually permitted to nominate candidates, and this requires a certain exercise of common sense on the part of the Registrar of Voters in each county as well as the Secretary of State.  Obviously, my supporters are largely battered down middle class working people who no longer trust the government to begin with.  They are anything BUT government insiders.  If only political insiders can maneuver the system then it is NOT a true “voter nominated” system.

I would guess that, in fact, the “top two” system was designed to protect the best funded insider candidates from even any hypothetical threat from outsiders like me, and that is, of course, a way of stifling change and preventing any real “dynamic” in the democratic process.  ”Top two” primaries arguably serve a system well-designed to engender a “thousand year reich”, ironic indeed since one would think that individuals of Barbara Boxer’s, Diane Feinstein’s and Henry Waxman’s background and ethnic origins would not WANT a thousand year reich….but perhaps the quibble was with the identity of the master race destined to rule for a millennium, rather than whether a unitary elite should have such power…. forever.

Remembering V-for-Vendetta and Serenity from 2005-2006

The only redeeming feature of Spring 2012 so far is a new movie, which equals and possibly surpasses in political insight my (obvious, previous) all time favorite: V-for-Vendetta.   V-for-Vendetta was a futuristic science fiction (literally based on cartoon characters based on a four centuries old English school boys’  rhyme about a highly manipulated historical even in 1605) and as such it served as an allegory about 9-11 and the “W” Bush (43rd Presidential) administration in the USA.   The lead characters, the Guy Fawkes’ masked “V” (Hugo Weaving) and Evey Hammond” (Nathalie Portman), were an amazing couple NOT in love (at least not romantically, and not in any way at all, at least not until Evey’s post-mortem eulogy) were, as cartoon characters are, difficult to relate to any ordinary people one might encounter in life.  

The brilliance of V-for-Vendetta was the incisive treatment of 9-11 and all that had happened in and around that date under the Bush 43 administration: barely a stone was left unturned to expose the rotten mould and horrible colony of insect life underneath it.  The sad part about V-for-Vendetta is that it’s message apparently resonated with so few people.  

As a movie, it should have had a national impact on political thought, revealing the ruling government as an oligarchy of hypocrisy, lies and fear through government media manipulation concealing a simple policy of orchestrated terrorism attributed to foreigners, specifically Islamic fundamentalists, in the justification of never-ending war, even though it was in fact the brainchild policy of the government itself.  

Above all, V-for-Vendetta reminded us of Adolf Hitler’s brilliant but evil insight, that the great mass of people will sooner believe a great lie than a small one.  Another movie concerning a “big lie” by the government was Joss Whedon’s beautiful epic Serenity.  The tale of the outer-space “wild-west racially non-discriminatory confederates” was, in so many ways, merely the extra galactic, historically unspecific, parallel to V.  Unlike V, Serenity did not focus on any specific modern event like 9-11, but  very generally shared a focus on governmental experiments in biotechnology and psychological manipulation as the root of transformational events in human history.  Of course, Serenity very unusually and distinctively echoed and memorialized the injustice of the Confederate defeat at the hands of a technologically superior Centralized government (“the Federation”).

Die Hungerspiele von Panem/Die Tribute von Panem (Totliche Spiele) (You’re a Damn Confederate, aren’t you?)

The new movie which in my mind at least now threaten’s V-for-Vendetta’s supremacy as the greatest political movie of our time premiered on Friday March 23, and is of course, the Hunger Games. (I confess I have not read Suzanne Collins’ books—everything I say here is based on the movie and the movie alone, which I found absolutely overwhelming—but I didn’t read Gone with the Wind until I was 26, by which time I had seen the movie at leas 30 times in my life).  The Hunger Games lacks any of the cartoonish elements of V-for-Vendetta and Serenity (as much as I like and appreciate the genuinely artistic value of those elements).  

My suspicions of Collins’ perspectives as those of a not-so-closet Confederate sympathizer gain more than moderate a bolster from the knowledge that, although born in Connecticut, the author was the daughter of a Vietnam veteran and spent her High School (i.e. critical formative identity) years in the heart of Dixie, specifically in Alabama in the 1970s…. where she attended  high school at the Alabama School of Fine Arts in Birmingham, where she was a Theater Arts major.  Oh yea, FWIW, the Alabama School of Fine Arts was founded by George Corley Wallace’s Wife, Governor Lurleen Wallace, in 1968, shortly before she tragically died of Cancer at age 41, and George Corley Wallace was Governor 1971-1979, all through Suzanne’s High School years.

Now, one way of looking at it is that, perhaps, the Hunger Games takes place after the collapse of the United States and Civil War to which the government news commentators in V-for-Vendetta made such frequent allusion.  According to those reports, the USA “the country that had everything” had become a “cesspool” of continental proportions due to its “Godlessness.”  While that’s a legitimate perspective, I think that the overwhelming weight of evidence and frame of reference in the Hunger Games is to the War of Southern Independence/War Between the States/War of 1861-1973, realizing that those dates are not the ones usually used in High School American History texts.

In fact, The Hunger Games in some of its visuals at least, almost approximates a kind of a futuristic Nanook of the North staged realism, focusing on the lives of the common people of the post-War (I mean Post-War Between the States) south, especially of the Appalachian regions of North Carolina (where The Hunger Games was filmed “on site”).  As in Whedon’s Serenity, the strong suggestion of Confederate nostalgia and sympathy is, to my mind at least, absolutely undeniable.  

It is too much to ask that we NOT see parallels to the War of 1861-65 and its aftermath when the “Treaty of the Treason” and “War” movie both recite that 13 Districts of “Panem” (“Panem” to my eyes sounds like a Hellenized partial translation of “E Pluribus Unum“, cf. Pangea) rose up against the Paternalistic “Welfare” Government that “fed them, protected them, cared for them”, that the District 12 setting is so obviously the REAL Southern landscape of coal-mining Appalachia, and that the poor whites of District 12 have a closely parallel lives and culture to at least the partially segregated black-African dominated population of District 11.

Without wanting totally to “spoil” the Hunger Games for anyone who hasn’t seen it, I will just summarize my interpretation of its wild popularity this way (aside from the obvious: a very human love story about two extraordinarily mature for their age teenagers who were unlikely ever to have fallen in love, but end up being “perfect” for each other, played by a genuinely handsome “All American Boy” lead and beautiful soft-spoken and emotional “Tomboy-type-Girl” who is so hot she literally sets her red dress on fire, combined with lots of action): Even though most Americans are not in fact hungry for food (that is the “Nano of the North” element reality of the starving South of 1865-1950, seeing oppressed, hard-working, underdogs whose primary source of protein was from very small game—squirrels, because the deer were almost all hunted out) people are clearly hungry for genuine justice and a fair playing field. (For one alternative, but to my mind, quite beautifully written and  excellent review of the Hunger Games, I recommend “The Feminist Spectator” by Princeton University’s Jill Dolan, published on April 4: http://www.feministspectator.blogspot.com/.  I somehow doubt that Professor Dolan would agree with me on the strong Confederate Sympathies implicit in The Hunger Games but there was once a President of Princeton University, the only Ph.D. ever to become President of the USA in fact, who thought that Birth of a Nation was the greatest historical drama in history, and portrayed the reality of his native south perfectly—unfortunately, that was also the Democratic President who signed into law (1) the 16th Amendment and Federal Income Tax, (2) the Federal Reserve Banking System, and the (3) the 17th Amendment, namely Woodrow Wilson….)

Hunger for Justice and Freedom

Like the residents of the 13 oppressed Districts of Panem, despite all government hypocrisy and lies to the contrary Americans both you and old today know that the odds are NOT in their favor and that, in fact, the odds are fairly hopelessly stacked against them.  And yet the system has this tiny escape valve: that about 1 in every 24 people can make it rich.  That is, one-in-twenty four of the oppressed can make it rich IF they’re willing to “play the government’s game” and basically, kill a lot of their fellow citizens in the process.  As of this April 13, 2012, I have seen the Hunger Games 5 times, and each time I’ve liked it more, seen more details.  I will have to read the books before completely integrating it into my thought processes about modern pop-cultural reaction to the impending doom that this American Life obviously faces, but I submit to you: the American people (on the whole, and certainly as a population compared to many parts of the world at the present and throughout history) may not be starving or hungry for food, but they hunger for justice and an even playing field, and they do not “relish” the very real prospect of a thousand years of subservience to “the government that feeds, them clothes them, takes care of them.”

Of Time and Space and Presidential Succession in the Leap Years…..

The Hunger Games takes place on the 74th anniversary of the institution of these gladiatorial combats.  The significance of that 74 years has bothered me.  On the one hand, it COULD refer to 1860 (the election of Abraham Lincoln and the secession of “District 1, South Carolina…) + 74 = 1934, the year in which Roosevelt’s New Deal started WPA reorganization of the South in earnest, or it could refer to the original publication date of the book, 2008, as the 74th year since 1934—or it could refer to both.  The coincidence, again, is hard to avoid.  1934 was the first full year of (de facto) Socialist Dictatorship in the United States (Franklin Delano Roosevelt was elected in 1932, took office in March 1933, and many of his first year legislative proposals only took effect in 1934).  2008, 74 years later, Barack Hussein Obama, the first Communist President of the United States, was elected and took office, “perfecting” or at least completing the process begun by Abraham Lincoln in 1860, a mere 12 years after the publication of the Communist Manifesto in London in 1848.  (See Al Benson, Jr., & Walter Donald Kennedy’s 2011: Lincoln’s Marxists, Pelican Publishing, Gretna Louisiana, a fine historical summary of the connexion between Communism and Central government predominance in the USA, a historical summary which is easy to read although not nearly well-enough documented with footnotes and source citations as professional historians would like and scholars generally would appreciate).

Another aspect of the Hunger Games is the correlation between the oppressive Central government of Panem and Edward Gibbons’ the Decline and Fall of the Roman Empire, on the one hand, and a heartless, Machiavellian version of the Social Darwinism of the late 19th century on the other.  The capital of Panem is degenerate in a distinctly Roman Imperial Silver Age manner (Rome’s “Silver Age” normally said to run from the death of Augustus in A.D. 14 through the death of Marcus Aurelius in A.D. 180).  Nero and even Caracalla (“Post-Silver Age” Emperor from A.S. 198-217) would have felt quite at home in the Capitol of Panem, I think.  But the “Emperor” himself is a distinctly late 19th century Anglo-American type (President Snow, played by Donald Sutherland), who has a Romano-”Robber-Baron’s” scorn for the “underdog” without any explanation or moral justification, just the political desire to keep himself and his world on top and everyone else underneath.  President Snow appears to share none of the cultural degeneracy of the Capital, but has a great deal in common with aristocratic Victorian gardeners of the late 19th century.  

Snow’s name is English, as are most of the names of the characters known from District 12.  Most of the residents of the Capitol City, however, and apparently of Districts 1-2, have Roman names: “Cato”, “Caesar”, “Seneca”, “Octavia”, and “Claudius” just to name a few…..  

So the Hunger Games follows the pattern of Serenity and V-for-Vendetta in another distinctly modern way (although all these movies do it well, and for good purposes and effect, quite a few others, such as Captain America and [the movie that I dread most]—Abraham Lincoln, Vampire Slayer, do it very poorly and for improper purposes): historical metaphors and mythic realities are conflated, merged, and reorganized.

In any event, there is a Leonard Cohen song that summarizes why the Hunger Games, as a historical-mythological and futuristic allegory of injustice and game rigging, is so wildly popular, and that song is:

The saddest difference between V-for-Vendetta and Serenity on the one hand and the Hunger Games on the other is the complete transparency of the society of Panem: “Everybody knows that the system’s rotten…. everybody knows that the war is over, everybody knows that the good guys lost.”  Everybody knows that the government that feeds the people, clothes them, and cares for them does not like underdogs.  President Snow is a late 19th Century-styled  avatar of George H.W. Bush (41st), Bill Clinton, George W. Bush (43rd), & Barack Hussein Obama all rolled into one.  

At least in V-for-Vendetta and Serenity, there still existed the apparent hope that revelation of truth could lead to revolution and change. 

But now President Obama signs the National Defense Authorization Act allowing indefinite detention of American Citizens on American soil without charges or trial, and he does so unblinkingly and unabashedly.  President Obama jingoistically adopts the dead Trayvon Martin as his own son in an effort to exacerbate racial tensions and divisions to his advantage in an election year at the same time that he tells the AIPAC Conference that he supports Israel’s quest to maintain ethnic homogeneity and integrity.  

There are no secrets in modern America, our Joseph Stalin, aka President Obama, has no need of Hitlerian, Rooseveltian, or “W” Bushian type “Big Lie”—he tells us all that he wants the power to take away all our rights, but asks us to trust him that he won’t really do it—except in the case of real underdogs, like, I guess, for example, George Zimmerman?  And speaking of that, how many of you imagine that George Zimmerman, whether he be called White, Hispanic, or Jewish, or all of the above, will get a fair trial?

So now to celebrate April 13 even further: WHERE WILL WE BE 74 years from now, or from 2008, say in 2082?  I predict we may well be in a New Dark Age, and not just because I’m not on the California Ballot for this year (although that is symptomatic).  

So far as “fixed games” go, what could be worse than a criminal prosecution set by agreement between Judges and prosecutors arranged through bribes?  Is that the American Way?  We wouldn’t like to think so.  In 1980, the year I graduated from the College of Arts & Sciences at Tulane and started graduate school at Harvard, the Ninth Circuit Court of Appeals in California said that “fixing” cases was not a normal judicial function and that no judicial immunity could attach to such activities: Rankin v Howard 633 F2d 844 _9th Circuit December 5 1980.  A short six years later, that same Ninth Circuit reversed itself and found judicial immunity from civil suit for such activities: Ashelman v Pope 793 F2d 1072 *EN BANC* 9th Circuit 1986

But the outrageous history of the suppression of judicial immunity just goes on and on through the subsequent citation history of Ashelman v. Pope to show how official immunity for prosecutors and the executive branch has almost merged with Judicial immunity to the point that the government is just one big immune mass of oppression against the people, and the modern government of E Pluribus Unum, aka “Panem” can prosecute you, jail you, and torture you, with complete immunity.

Was Martin Luther King, Jr., really a hero? Was he a tool utilized by the United States Government for certain purposes, discarded when he became too influential? Who was he, really? Who made his career what it was? Robert Kennedy? George Corley Wallace? Herbert Hoover? Just to what degree has United States History been a series of carefully orchestrated since 1898? 1913? 1919? 1933? What is real and what is fantasy? How much of the fantasy was staged, scripted, and professionally performed? 9/11/2001 almost certainly was. How about Waco 1993 & Oklahoma City 1995? World Trade Center 1993? Dar es Salaam & Nairobi 1998? How many national elections? And since when?

I was playing this very inspiring video with JFK, MLK, Jr., and Ron Paul on my I-Pad to a small group in Room 2013 on the second floor of the the Los Angeles County Registrar’s Office for Candidate Registration today. Kennedy was at least nominally a Democrat, although it appears he may have been assassinated, at least in part, for opposing the Federal Reserve and in particular the plan to take silver out of circulation, and hence as a basis for the United States Dollar….which had been “silver” since at least the 1780s…. I was waiting while an even smaller group of unusually efficient bureaucrats processed the paperwork necessary to put my campaign “on-line.”

And so it was that on Friday, December 30, the last business day of 2011, I filed formal campaign papers to run for U.S. Senate against Dianne Feinstein. Many of California’s representatives in Congress are traitors, and should be removed, although I noted with some satisfaction that in the Los Angeles Basin proper, only the very oldest New World Order Advocate/Brave New Warrior Henry Arnold Waxman, voted for the National Defense Authorization Act of 2011…(Fiscal 2012, aka “Indefinite Detention without charges, due process of law, or habeas corpus). Nancy Pelosi, of course, voted with Waxman and the establishment, as did Adam Schiff and Howard Berman, but in the spirit of fairness, I think we owe at least the following 18 Democratic and 4 Republican Representatives on the California delegagtion credit for their courageous “no” votes:

I am grateful that the primary is non-partisan, because partisan labels “Democrat” and “Republican” now mean nothing except that third-party candidates are doomed. The “top two” selection process without a primary and runoff is ALSO unfairly stacked against the outside, but we shall see whether the number of ordinary Californians (in the tens of millions) can recognize their common grounds and identify with me. Anyone interested in promoting “diversity” in the Democratic Party and U.S. Senate by electing a Conservative, sound money, pro-Private Property, pro-Common Law, pro-10th-Amendment, Libertarian Candidate to replace the hopelessly establishmentarian and politically correct Senator Dianne Feinstein, who has played a leading role as member of the Senate Committees on the Judiciary and Intelligence in approving and ratifying the corruption which shackled America, should seriously consider backing me for Senate.

To elect anyone with my “outsider” credentials and background would “send them a message” inside the Washington Beltway that the people are uncomfortable and dissatisfied with the Status Quo and want real change.

My specific platform planks are:

(1) restoration of full First Amendment rights, and the abolition of all forms of governmental regulation of speech and expression, including the elimination of penalties for advocacy and repeated submission of petitions for redress in the Federal Court system.

One of my favorite passages in the Gospels is Luke 18:1-8, the Parable of the Unjust Judge—which tells of a Judge to whom a widow repeatedly brings her petition for redress, and which Judge finally grants her relief rather than hear her plea again.  Apparently, in Ancient Israel, it was unimaginable that any person would be penalized for repeatedly seeking justice—even it was by no means certain that this particular widow or any person would obtain anything by her efforts.  The Federal Courts, with Congressional support, have all but cut off the power of the people effectively petition through the Courts.  Federal Courts seem to exist only for the benefit of large corporations and law firms.  This particular corruption must end, even though, harking back to one of the passages in the Hebrew Bible, it is an ancient problem.

The following, from Isaiah 59, seems to me to embody my own frustration, and the frustration of many I know, with the Judicial System and its most numerous “officers of the court” who are the lawyers (one of my Great Grandfathers was a Judge & Justice in Louisiana—according to family legend he had a plaque on the walls of his chambers which read, “Dead Lawyers Lie Still”.   ISAIAH 59:

4 No one calls for justice;
no one pleads a case with integrity.
They rely on empty arguments, they utter lies;
they conceive trouble and give birth to evil.
5 They hatch the eggs of vipers
and spin a spider’s web.
Whoever eats their eggs will die,
and when one is broken, an adder is hatched.
6 Their cobwebs are useless for clothing;
they cannot cover themselves with what they make.
Their deeds are evil deeds,
and acts of violence are in their hands.
7 Their feet rush into sin;
they are swift to shed innocent blood.
They pursue evil schemes;
acts of violence mark their ways.
8 The way of peace they do not know;
there is no justice in their paths.
They have turned them into crooked roads;
no one who walks along them will know peace.
So justice is far from us, and righteousness does not reach us.
We look for light, but all is darkness;
for brightness, but we walk in deep shadows.
10 Like the blind we grope along the wall,
feeling our way like people without eyes.
At midday we stumble as if it were twilight;
among the strong, we are like the dead.

we moan mournfully like doves.

for deliverance, but it is far away.

and righteousness stands at a distance;
truth has stumbled in the streets,
honesty cannot enter.
15 Truth is nowhere to be found,
and whoever shuns evil becomes a prey.

(2) restoration of full Second Amendment rights, on the grounds that the power of the people to defend themselves against government is the necessary backup to the freedoms secured by the First Amendment (an all-powerful army and police force with the monopoly of legitimate violence is simply incompatible, in both the long and the short term, with meaningful individual or social freedom). We must reinvigorate the concept of the civilian militia, composed of every adult man and woman in society.

Switzerland and Israel both follow this model of public participation, which just shows that there are no guarantees of anything in life or politics: Switzerland by its rigid neutrality has avoided direct involvement in all the wars of the past century, while Israel has been in a state of nearly constant war since even before its creation 63 years ago in 1948.

In the United States, we have somehow combined both worlds: up until 1992, we had enjoyed a century of nearly complete domestic peace.  Discounting several dozen essentially disorganized and nearly random urban riots relating to the Labor movement in the 1890s and the Civil Rights and Vietnam War Protest movements in the late 1950s-early 1970s, there was no serious conflict or “state of hostility” on United States soil following the withdrawal of occupying forces from the South in 1877 and the dawn of the “Decade of Domestic Terrorism” which ran from 1992-2001, and led to the transformation of American government and the near obliteration of civil rights.

(3) freedom of contract from governmental interference of every kind;

To fully implement this phrase would eliminate such a large portion of the United States Code and the work of lawyers generally that overtaxed pulp-tree farms (and recycling plants) everywhere would heave a sigh of relief.   Just as an example, the IRS code and many Federal Courts frown on contracts for barter or exchange—meaning that the most basic instinct of exchange of goods, labor, or services of any kind for negotiated substantive value without assigning any formal cash value has been very nearly made a Federal crime.

(4) reduction in governmental subsidies with a goal towards ultimate elimination, of  corporate welfare, individual welfare, and all programs which foster dependency on the state rather than freedom and social-interdependence of people on each other as equals—again of absolutely every kind;

(5) reduction in governmental power over all aspects of human life, but including especially but not limited to all regulations which tend to affect individuals as members of families, and to alienate the individual from his family as a considered governmental “benefit” or “service” in support of “domestic relations” laws; and also including all regulations which tend to impose uniform philosophies or beliefs, or enforce normative standards of human philosophy, religion, or ideology of any kind.

Returning to the point about the First Amendment above, a free society (such as existed in the United States during the Colonial, Early Republican, and up through mid-19th century period at least) must foster the development of new and divergent lifestyles based on emergent new philosophies rather than trying to straightjacket society and culture into a “one-size” fits all narrow menu of politically correct and socially acceptable choices.

(6) abolition of government programs such as massive environmental regulation (including the construction and maintenance of dams and nuclear power plants) which necessarily increase the dependence of the people on the government and government controlled monopolies for their very survival;

(7) the abolition of all kinds of official immunity, including but not limited to judicial and prosecutorial immunity, for violation of civil rights, and especially for those violations and abuses of office which design or promote private or unofficial political and “social engineering” goals;

(8) any and every attempt by the state or federal government to regulate or control family organization in the name of “public welfare”;  here again, multiple apparently opposing interests may be reconciled creatively.   The interests of so-calle “social conservatives” will be served because the Federal government would no longer subsidize the state-sponsored breakup of families, pitting husbands and wives against each other in an eternal redistributive battle which ultimately enriches only lawyers and empowers only Judges and social workers.   Moreover, the power of Churches, Religious, Philosophical, and/or even Private Social or cultural groups to institute, promulgate rules, and regulate marriage and the education of the young will be restored.

However, persons of a socially liberal bent will find that the abolition of all civil and criminal restrictions on “gay marriage” and any other (victimless, voluntary) “alternative lifestyles” will lead to complete individual choice and private decision-making, limited only by individual imagination and the criminal laws against physical injury and slavery of any kind.

In a truly free society, if the Unitarian Universalist and other churches wish to solemnize gay marriage, they shall do so according to their own rules and regulations without leave or license from any state officer. But at the same time, the Conservative Presbyterians and Southern Baptist Convention will be free to ban and forbid membership to any individuals choosing what appears to these groups an “ungodly” lifestyle.  The marketplace of ideas, in short, will be open to all competing models, and the triumph or failure of any ideology will be utterly without beneficial or detrimental consequences in the law.

(9) a restoration of strict construction of the constitution and civil rights as respecting life, liberty, and property ownership;

(10) a complete restructuring of the banking and government finance systems, including but not limited to abolition of the Federal Reserve and the Federal income tax;

(11) a restoration to the people of the power (and the duty) to structure their own lives and social relations by contractual agreement without governmental interference, the major legitimate function of the courts being to enforce and judge the fairness of private contracts, including but not limited to marriage contracts and other agreements relating to domestic relations, such that the marriage license and state-sponsored divorce should be forever abolished and erased from the American social scene, restoring true freedom of association and freedom of religion to the people so that MEANINGFUL cultural and social diversity can flourish in the absence of regulation.   In this connection, all victimless crimes should be abolished, and the definition of “crimes against society” or humanity should be strictly limited to those behaviors which actually place real individuals in physical danger.  ”Moral” or “Mental” injuries such as the consequences, for example, of merely “hateful” expression (without associated conduct such as assaultive behavior) must no longer be allowed to be a cause for criminal punishment (although tortious actions for “emotional distress” and other forms of non-physical victimization would be greatly expanded and liberalized, although subjected to the funnel and fulcrum of trial-by-fully-informed juries).

(12) corporate and professional, like governmental immunity, should be abolished or at least severely curtailed so that corporate, like governmental, officers, cannot hide behind legal shields while they wield immensely destructive financial swords, (

13) electronic voting should be carefully and independently monitored and subject to citizen audits, as should all governmental actions, but electronic voting should be supplemented by duplicative paper ballot receipt systems where the voter casts his vote electronically, but then casts and keeps a confirming paper copy of his vote, so that recounts will have double and triple built in security systems,

(14) all ancient prerogative writs, including quo warranto should be restored and forever guaranteed to the people,

(15) Federal judicial rules should be reformed in favor of freely amended pleadings and limiting the discretion of judges to dismiss complaints based on subjective criteria such as “plausibility”, while the right to decide all matters of credibility and fact-finding should be strictly reserved to juries, which should also have the power to decide whether laws are fairly applicable in each individual case.

I submit that I am a candidate for all the people.  As an individual, I was born a “WASP” from the Upper Middle Class of White America, and for much of my life I thought of myself as a “Goldwater-Reagan” Republican, albeit with deep admiration for Conservative Democrats such as populated the South through at least the 1970s.   But as an Anthropologist and Historian, I should hope I have a deeper than average appreciation for the mechanics and implications and demands of REAL socio-cultural and political diversity.

And because of my unusual individual life-history, I should find a “common table” with traditional elements of the California “Blue State” Democratic coalition including California’s Hispanics (I am fluent in Spanish and support official bilingualism in Government and the Court System on what you might call “the Canadian Model”), as California’s African Americans (I have suffered more than my share of unjust judicial and financial oppression and I recognize that they have been uniquely victimized as a group), along with California’s labor unions, for whom I would always defend the rights of freedom to organize, freedom to associate, and freedom to negotiate and contract without governmental interference.

Finally, I think that my social-”diffusion of power” program regarding lifestyle choices and values should appeal not only to every ethnic group belonging to the California “plurality of diversity” but also to every Californian who shares in this state’s tradition of eccentricity and the embrace of real normative divergence. The socialist tyranny which has characterized California politics and social policy during most of my lifetime stands in marked contrast to the real diversity of the California population—at least by origins.   All who enjoy support California’s diverse makeup must admit that such diversity cannot meaningfully coexist with homogenization through coercive unitary educational, financial, and legal systems.   “Good fences make good neighbors” and the freedom the build good fences and maintain actual distinctions is one of the freedoms to whose protection I am most deeply committed.

Above all I think I will appeal to California’s homeowners and property owners of every ethnic and class background: like no one else in this or any other race, I will fight first and foremost to restore the integrity and reality of private property against all Federal Tax-based schemes and programs of securitization and transfers of real ownership as a result of corrupt banking and lending laws.   A

s an anthropologist and archaeologist, I think I have a better appreciation for the cultural history and diversity of all groups in California than anyone else, and understand the importance of maintaining identity and actual diversity by avoiding forced assimilation of any and every kind: “Vive la difference.”

As strongly indicated above, I also support absolute freedom of expression and religion, and would work to remove all Federal Support for or mandates involving state licensed or controlled marriage or relating marriage or support to the social security system, which has turned the State Family Courts into surrogate Federal Tax Collection facilities for the purpose of welfare and wealth redistribution.

As a United States Senator I would demand proof of the legitimacy and honest integrity of all our programs, institutions, and officers, including but not limited to the monetary system (the value of the dollar, the threat of renewed inflation), the Federal Reserve Banking System as a whole, every branch of the Federal Government, and yes, even of the Presidency and of the current occupant of the White House.

I would specifically fight in the U.S. Senate for amendments to the Civil Rights Statutes of Titles 18, 28, and 42 which would amendments would ensure the color blind application of the civil rights laws.   “Equal opportunity under the law” must flourish and promote itself as among the greatest of American Values, not so much as a divisive but unifying slogan and ideal in our courts—available to the members of the DAR and recent immigrants alike.

I would also fight for the repeal of the recent National Defense Authorization Act, the Patriot Act, and the Real ID act, FISA, and the secure restoration of meaningful Habeas Corpus, and the removal of every sort of unnecessary governmental program intruding upon or regulating any aspect of business or private life.

My approach to developing a policy for California’s ecological and environmental would be simple: nature is best, all modifications of nature which pervert demographics from their natural tendencies are bad.  In particular, no more dams should ever be built with Federal Funds and those dams which exist now should be subjected to retrospective environmental assessment to see which can be removed to restore rivers and lakes to their natural configurations.  I think that the restoration of natural hydrology will ultimately lessen the need for governmental regulation and intervention in economic and social life, as well as solve many of the most pressing environmental threats to all life on earth.   I will support every sort of incentive to develop non-fossil fuel energy bases EXCEPT hydroelectric based on damming our rivers.  Deserts should probably remain dry rather than the site for suburban sprawl.  Restoration of natural water flows will decrease the tendency for the United States Federal Government and State Governments to become modern day examples of “Oriental Despotism.”  Energy independence for the individual household and family or local communities through wind and solar power is the ideal to be preferred.

Why is Senate Bill 1867 so bad? In the Exercise of Absolute Power, Justice Forbids Status Crimes and Requires Blindness to all Categories of People (Prejudicial legal Classification of “Protected” or “Disfavored” Groups ALWAYS violates due process and leads down a short, steep, and very slippery slope straight into Totalitarianism)

Someone named “Jonathan” wrote in and asked: “So I’m just curious to know whether you would extend miranda rights to foreign terrorists operating on American soil? Why should an American who joins say Al Qaeda be entitled to a trial or a lawyer or any other right under our Constitution?”***(note below)

My answer to these questions [and the pathetic Senate debate excerpted here from the December 7, 2011 Daily Show with Jon Steward (http://www.thedailyshow.com/watch/wed-december-7-2011/arrested-development)] is that, contrary to current civil rights practice in the United States, governmentally imposed categories and mandatory categorization of people NEVER promotes equality but ALWAYS tends to support and advance both tyranny and real inequality.  Nobody said it better than Rand Paul: “Detaining citizens without a trial is not American.”

By contrast, voluntary categorization, classification, and all assertions of identity originating from the people are among the surest guarantors and symptoms of freedom and genuine equality.  In fact, I would submit that the voluntary and intentional creation and maintenance of identity is one of the Great Traditions of the United States of America which has defined some of the greatest and most distinctive events in the history of this Continent, from the settlement of the Pilgrim Nonconformist Separatists in New England in the 17th Century through the “Great Awakening” of the 18th Century, the Mormon emigration Westward (and many smaller “separate community, separate lifeway” experiments) in the 19th Century (including the Amish), right up until the Cultural upheaval of the 1960s, when “Hippies” and “Flower Children” sought to give a new meaning to Freedom in America.   The decision to maintain cultural separateness has historically been protected by the United States Supreme Court in the greatest of its “substantive due process” decisions (e.g. Meyer v. Nebraska, 262 U.S. 390, 399, 401 (1923) and Wisconsin v. Yoder,  406 U.S. 205, 232—233 (1972)).**  

I would go so far as to maintain that involuntarily classifying people  or sorting them into “favored” and “disfavored” groups as a matter of law without trial always leads to violations of due process.  No movies or other literature ever illustrated this inherent injustice in the prejudicial and discriminatory processes of classification and labeling people one way or another than V-for-Vendetta in 2005 and Paul Verhoeven’s Black Book in 2006.  

I would also say that the only real PURPOSES people EVER have in classifying their fellow man (and woman) into involuntary groups is to deny them due process, and that this is simply intolerable under the American Constitution.

Note that the Bill of Rights contains no categories of persons, but only restrictions on the power of government: absolutely and unqualifiedly stated.  Rather, Amendments I, II, IV, IX, and X refer simply to “the people.”  Amendment V refers to “no person” and “any person”, since criminal prosecutions are almost always, by definition, brought on a one-by-one individual basis.  Even Nazi Germany, for example, never indicted “the Jews”, nor, during the 1950s, were there ever prosecutions against “the Communists”.  Due process of  law simply does not allow for categorical indictments.

Finally, Amendment VI refers only to “the accused”, again an individual classification.  (Despite the customary usage of the masculine gender throughout the bill of rights when referring to individuals, no one has ever suggested that the framers intended these rights only to apply to men: it was the grammatical economy of the time not to say “he and she” or “his and hers” or “him and her” as it is sometimes thought more acceptable to do now.)

So these are the major reasons why, in response to Jonathan’s question, I believe that “Miranda rights” (i.e. the full inventory of rights Fifth and Sixth Amendment rights) should be extended to all “foreign terrorists operating on American soil.”  To do otherwise would be to “prejudge” both who is foreign and who is a terrorist, and would  make both words “foreign” and “terrorists” into prejudicial, disfavored categories exactly analogous to “Negro” under Jim Crow in the South, “Jew” in Nazi Germany, and “Bourgeois” or “Capitalist” in Stalinist Russia.

What the 1996 AEDPA, the 2001 PATRIOT Act, and the Senate in passing S.B. 1867 have done, though, is actually MUCH worse than MERELY “discriminating against foreigners and terrorists” and in fact, much worse than “merely discriminating against, Blacks or Jews or even (to give two give two examples of a super-irrationally feared and overused but extremely vague pair of categories in modern law) “Sex Offender” and “Illegal Immigrant.”  No, the Category of “Terrorist” alone is “void for vagueness” as a matter of law.  See Papachrisou v. Jacksonville, 405 U.S. 156, 169-170 (1972), and Kolender v. Lawson (Kolender v Lawson, 461 U.S. 352 (1982), attached here in adobe.pdf):

. . . “As generally stated, the void-for-vagueness doctrine requires that a penal statute define the criminal offense with sufficient definiteness that ordinary people can understand what conduct is prohibited and in a manner that does not encourage arbitrary and discriminatory enforcement.” Kolender v. Lawson, 461 U.S. 352, 357, 75 L. Ed. 2d 903, 103 S. Ct. 1855 (1983). 

(On the whole, the text of Papachristou v. City of Jacksonville is more amusing for its analysis of how the distinction between “idle rich” and “vagrant” under the City of Jacksonville, Florida’s “Vagrancy” ordinance blurred into meaninglessness….Papachristou v City of Jacksonville 405 US 156 92 SCt 839 02-24-1972).  ”Terrorism” as a status crime under S.B. 1867 or category of criminal conduct is void for all the same reasons as was “vagrancy.”

What the Senate has done in S.B. 1867 is worse than “mere discrimination” against any of those categorical groups because in each case (Black, Jew, Sex Offender, Illegal Immigrant) there is at least a fairly narrow and objectively determinable set of traits or characteristics which define membership in the group.  There may be ambiguity at the edges, people of mixed race and ethnicity, “sex offenders” convicted of “statutory rape” where the girl lied about her age in  an objectively credible way, cases of “illegal immigration” where family hardship brought or kept people together for mutual support in violation of immigration laws, but on the whole, Blacks, Jews, Illegal Immigrants, and Sex Offenders all know who they are, and they can either “lie low” or decide to leave the country if they are able.

What is so totally monstrous about the category of “terrorist” in particular and “foreigner operating on American soil” is that theses terms are simultaneously vague, overbroad and subject to arbitrary and capricious application to the degree that even racial categories and categories based on convictions for violation of laws are not.    And in the context of modern America, merely calling someone a terrorist MAKES them a terrorist, especially (but not only) when it is a member of the government making the accusation.  To allow denial of Fifth and Sixth Amendment rights to individuals accused of terrorism is simply to allow the government to deny these rights to anyone it wants, whenever it wants, for any reason it wants.  We now have a “Government of the Dictators, by the Dictators, and For the Dictators” (as Lincoln’s Gettysburg Address should honestly and probably have been written).   The dictatorial decision about who is a terrorist is left open—WIDE OPEN.   The Office of the Attorney General of the State of Texas (Greg Abbott and James Carlton Todd) have been calling the author of this blog a “dangerous paper terrorist” since 2005.  (Yes, I admit it, I have occasionally thrown paper airplanes at government buildings in protest against policies with which I disagree, OK?   So I guess that means I’m off to Guantanamo Bay? or the Domestic Equivalent?   In fact, when arrested by Live Oak at the edge of the Suwannee River on the order of Houston Federal Judge Lynn N. Hughes in August 2006, they raised the prospect of Guantanamo Bay for me in Jacksonville, only half joking…at most half….or maybe not at all I’m still not sure, but here I am in West L.A./Santa Monica).   It is not trivial at all.  They have been throwing around these terms like “paper terrorist” ever since 9/11, and the purpose is, frankly, to create an atmosphere of terror and prejudice against the people so labelled.  After that experience, I just “went with it”.  But even in 2005, there was another disbarred attorney (Zena D. Crenshaw NJCDLP “National Judicial Conduct & Disability Project) who came in from Indiana to help Francis Wayne Williams-Montenegro with my family law case in 2005.  She tried to show that the Attorney General was trying to prejudice the Court against me (it was difficult to make the Williamson County 395th Judicial District any more prejudiced against me than it was) by calling me “the most dangerous paper terrorist” in Texas, but it didn’t go anywhere.  Zena rightly predicted that they were trying to sweep all Judicial Reform activists into the category of “terrorists.” In fact, Judicial Reform, Anti-Income Tax/IRS Reform, Prison Reform, Anti-Big Oil Activists, we’re ALL terrorists now.  The FBI has guidelines and we “fit” even before S.B. 1867 became law.  I said to Zena in 2004-5 and I say now that to be accused of anything so preposterous is a “red badge of courage” and I wore it proudly (still do in fact), despite the fact that my saying so on videotape resulted in my getting arrested AGAIN in December 2007 in Mexico City and brought to Los Angeles (this time on the order of Judge Janis Graham Jack of Corpus Christi, in the same Southern District of Texas in which Judge Lynn N. Hughes sits, and which George H. W. Bush [Bush 41st] calls “home”).

The way “Jonathan’s” questions above are written actually illustrated just how bad S.B. 1867 is: After asking whether I would “extend Miranda Rights to foreign terrorists operation on American soil” (I submit that such rights have existed ever since the adoption of the Bill of Rights and the problem is not “extending” such rights under the Fifth and Sixth Amendments, but in taking them away), “Jonathan” then asks: “Why should an American who joins say “Al Qaeda” be entitled to a trial or lawyer or any other right under our Constitution?”

This question is probably the scariest of all, if serious and not merely rhetorical. My answer is simple: BECAUSE AN AMERICAN WHO JOINS AL QAEDA IS STILL AN AMERICAN, THAT’S WHY.  But Again, to Repeat, and this is SO IMPORTANT: the Bill of Rights do not discriminate between Citizens and Non-Citizens, Americans and Non-Americans, just “people” and “persons” (so the only categorical distinctions made implicitly, if any, would be those between “people” or “persons” and animals [sorry, PETA][or plants I guess---wheat plants have any Constitutional rights before being eaten...even for arbitrary and capricious purposes as being ground into flour and made into extremely unhealthy and fattening cakes or cookies....]) .

But then that does wrap up this little exercise about why S.B. 1867 is such a very bad law: Americans can be characterized as “terrorists” and reduced to ashes by such categorization.    And it could be that “Jonathan” has more confidence in the meaning of these terms than I do.  I happen to believe that “Al Qaeda” was basically created and established, fostered, aided, and abetted, by the Bush-Reagan administration and set loose to create “domestic terrorism” to justify the very repression of civil liberties which have taken place since the Fall of the Berlin Wall in 1989-90 and the consequent evaporation of the Cold War as a reason for suppressing freedom and the Bill of Rights.  So I think “Al Qaeda” is a government made fraud, that 9/11 was a U.S. government-sponsored “false flag” attack, and that Oklahoma City MAY have been a government-sponsored incident of false terrorism.  (Please view this brilliant 5 minute summary, text also copied below at Note*: http://www.corbettreport.com/911-a-conspiracy-theory/)

In support of these hypotheses of mine, I can only point to patterns of history: from 1963-1972, from John F. Kennedy through George Corley Wallace,  a series of public assassinations by public shootings of “troublesome” non-conformist politicians took place in a waive of “lone gunmen” with no precedent in American History, and no tradition that survived.  The failed attacks on Ford and Reagan were just that, failures, and were easily traceable either to Squeaky Fromm/ Manson or John Hinkley personal and family psychological problems.

It is hard to believe that the generation that came of age during the decade 1963-1972 simply bred a series of “lone gunmen” who acted without obvious motive (but all happened to oppose, directly or indirectly, the policies and power of Lyndon Baines Johnson, even though John F. Kennedy, Robert F. Kennedy, Martin Luther King, Jr., and George C. Wallace were all at least nominally allies or at least in the same [Democratic] Party at one time or another, though Wallace ran Third-Party [American Independent] in 1968 and Malcolm X, though he hated all Democrats “categorically” as “Dixiecrats” was partially allied with Johnson on the question of Civil Rights).

It is equally hard to believe that another Decade long episode, namely the series of incidents of Domestic “Terrorism” or at least confrontation between Federal and Private parties that the Government sought to characterize somehow as “terroristic” from Ruby Ridge in 1992-9/11/2001, was merely a historical accident and not planned.  ALL the major terrorist acts since 9/11 have occurred in Europe….THAT is the legacy of 2001-2011.  Every decade has a different set of problems, with no overlap at all between the “Assassination” decade and the “Terrorism” Decade (unless you count the early 70s epidemic of hijacking which led to early restrictions on air-travel as partly overlapping with the decade of assassination).   No, it seems that the Government picks its crisis formula based on what it wants to achieve and then “stages” criminal acts and history accordingly.   So, Jonathan, whoever you are, does this answer your question?  Do you really want to live in a country where they can decide, tomorrow, that YOU are a terrorist and lock you up forever?

****I know only a few Jonathans… I hope that “Jonathan” who is the author of these questions is posing them only for rhetorical purposes to test my commitment to moral consistency and philosophical coherence.  Because, if the author of these questions is serious, and if he reflects widespread opinion in America, then…. I’m even more depressed about the passage of Senate Bill 1867 than I was before.  I can only hope this Jonathan is Dr. Jonathan Harris Levy (Brimstone & Co.)(http://www.brimstoneandcompany.com/), formerly attorney for noted Orange County Dentist Orly Taitz and (the one and only) other William Howard Taft Law School graduate I’ve ever encountered, because that would just confirm my suspicion that Orly supports the 93 bad guys who voted for this bill….  If it’s anyone of any higher level of academic achievement in law than the William Howard Taft Law School involved in presenting these questions, well that’s just demoralizing….

**If we desire homogeneity in this Country, we are well on the way to a “shake and bake” society of people no more different than one box of hamburger helper is from another.  I do not personally desire such homogeneity, but I think it is best left to the people to make voluntary associations and define local color and establish meaningful cultural diversity by devolving power downward rather than concentrating it upward.

TRANSCRIPT: On the morning of September 11, 2001, 19 men armed with boxcutters directed by a man on dialysis in a cave fortress halfway around the world using a satellite phone and a laptop directed the most sophisticated penetration of the most heavily-defended airspace in the world, overpowering the passengers and the military combat-trained pilots on 4 commercial aircraft before flying those planes wildly off course for over an hour without being molested by a single fighter interceptor.

These 19 hijackers, devout religious fundamentalists who liked to drink alcoholsnort cocaine, and live with pink-haired strippers, managed to knock down 3 buildings with 2 planes in New York, while in Washington a pilot who couldn’t handle a single engine Cessna was able to fly a 757 in an 8,000 foot descending 270 degree corskscrew turn to come exactly level with the ground, hitting the Pentagon in the budget analyst office where DoD staffers were working on the mystery of the 2.3 trillion dollars that Defense Secretary Donald Rumsfeld had announced “missing” from the Pentagon’s coffers in a press conference the day before, on September 10, 2001.

Luckily, the news anchors knew who did it within minutes, the pundits knew within hours, the Administration knew within the day, and the evidenceliterally fell into the FBI’s lap. But for some reason a bunch of crazy conspiracy theorists demanded an investigation into the greatest attack on American soil in history.

The investigation was delayedunderfundedset up to fail, a conflict of interest and a cover up from start to finish. It was based on testimonyextracted through torture, the records of which were destroyed. It failed to mention the existence of WTC7Able DangerPtechSibel EdmondsOBL and the CIA, and the drills of hijacked aircraft being flown into buildings that were being simulated at the precise same time that those events were actually happening. It was lied to by the Pentagon, the CIA, the Bush Administration and as for Bush and Cheney…well, no one knows what they told it because they testified in secretoff the recordnot under oath and behind closed doors. It didn’t bother to look at who funded the attacks because that question is of “little practical significance“. Still, the 9/11 Commission did brilliantly, answering all of the questions the public had (except most of the victims’ family members’ questions) and pinned blame on all the people responsible (although no one so much as lost their job), determining the attacks were “a failure of imagination” because “I don’t think anyone could envision flying airplanes into buildings ” except the Pentagon and FEMA and NORAD and the NRO.

The DIA destroyed 2.5 TB of data on Able Danger, but that’s OK because it probably wasn’t important.

The SEC destroyed their records on the investigation into the insider trading before the attacks, but that’s OK because destroying the records of the largest investigation in SEC history is just part of routine record keeping.

NIST has classified the data that they used for their model of WTC7′s collapse, but that’s OK because knowing how they made their model of that collapse would “jeopardize public safety“.

The FBI has argued that all material related to their investigation of 9/11 should be kept secret from the public, but that’s OK because the FBI probably has nothing to hide.

This man never existed, nor is anything he had to say worthy of your attention, and if you say otherwise you are a paranoid conspiracy theorist and deserve to be shunned by all of humanity. Likewise himhimhim, and her. (and her and her and him).

Osama Bin Laden lived in a cave fortress in the hills of Afghanistan, but somehow got away. Then he was hiding out in Tora Bora but somehow got away. Then he lived in Abottabad for years, taunting the most comprehensive intelligence dragnet employing the most sophisticated technology in the history of the world for 10 years, releasing video after video with complete impunity (and getting younger and younger as he did so), before finally being found in a daring SEAL team raid which wasn’t recorded on video, in which he didn’t resist or use his wife as a human shield, and in which these crack special forces operatives panicked and killed this unarmed man, supposedly the best source of intelligence about those dastardly terrorists on the planet. Then they dumped his body in the ocean before telling anyone about it. Then a couple dozen of that team’s members died in a helicopter crash in Afghanistan.

The extremely, tragically, humiliatingly short short role of honor of those who voted against Senate Bill 1867 includes: Tom Coburn (R-OK); Tom Harkin (D-IA); Mike Lee (R-UT); Jeff Merkley (D-OR); Rand Paul (R-KY); Bernard Sanders (I-VT); Ron Wyden (D-OR); 3 Democrats, 3 Republicans, 1 Independent; and three cheers for Oregon: you are the only state with TWO Senators who stood up against the monstrosity of indefinite detention of any accused person, regardless of citizenship or national origins, in violation of the Constitution.

Senate Bill 1867 represents nothing but Stalinist Communist Dictatorship at its worst.  This is Oriental Despotism installed and housed in America under the Flag of Our Fathers.  Did we fight the Kaiser, Hitler, and the Cold War only to institute such things as this at home?  Did we take in thousands of refugees from Vietnam after 1974-75 because we offered them a worse life than they would have had along the Mekong Delta?  I think not.  I defy and deny the right of any Senator who voted for this bill to call himself an American, much less a Patriot.

All 93 Senators who voted for S.B. 1867 should be removed from office (by special recall election if necessary: Barbara Boxer, for instance) and sent to Singapore to be prosecuted and punished as major Drug using narcotics-offenders for whatever kind of crack they’re smoking that makes them think this is all right, because it is not.   Dianne Feinstein tried to make a few meaningless amendments at the last minute (which passed) but she deserves condemnation not praise for trying to “fake” a little amelioration in this bill where there was none.  What happened that even Mark Udall of Colorado voted for the bill after his amendments failed?  To HELL with Florida’s Marco Rubio, Louisiana’s David Vitter, Texas’ John Cornyn, and every other cowardly craven Senator who voted in favor of this bill, including every other Senator who ever pretended to be in favor of freedom or the Constitution.   These are the times that try men’s souls, and the trial of 93 Senators for Treason is way overdue to begin right now.  If I am elected to the United States Senate from California I swear on the graves of my grandparents, my father’s soul and my mother’s heart that I will fight to erase the past twenty years of freedom-suppressing legislation from the United States Statutes at Large and U.S. Code until no trace of them is left, either in those statutes or in the Code of Federal Regulations nor in any guidelines to law-enforcement officials having any force or effect on the construction or interpretation of the law.  To HELL with Lindsey Graham, Joe Lieberman, John McCain and Carl Levin and all the lot of other fakes and phonies.  To HELL with both of California’s Com-Symp Senators who would turn America into one vast prison camp in the name of “Security.”

Since the Government of the United States Fears Freedom and the Constitution to the point of erasing our Freedom and the Constitution to Oppose Terrorism, and since the United States Government apparently believes it has a monopoly on truth and wisdom which must be protected and propped up by manifest injustice to the end that they (the Government) can protect us and keep us secure, then to all the People of California and the Nation, for Family, Home and Freedom: I wish to make it very clear that I am a Terrorist!

In 1964, Senator Barry Goldwater accepted the Republican nomination for President by declaring, “I would remind you that extremism in the defense of liberty is no vice! And let me remind you also that moderation in the pursuit of justice is no virtue!”  It may or may not be a related concept, that the end of Stanley Kubrick’s 1960 movie Spartacus (which was filmed the year I was born and released the same week in October that I was baptized, just before my parents set sail on the Queen Mary for England), the Romans offer the slaves who survived the war amnesty if they will hand over “the one known as Spartacus” and they all stand up and claim, one after the other, in a rising chorus, to be Spartacus.   If the government is terrified of freedom and the Constitution to the point that it seeks to outlaw our heritage of truth, justice, and the American Way for their own “security”, then I submit that every red blooded American has no choice but to stand up for Patriotic Terrorism, and I here to do that right now.  The movie  V-for-Vendetta celebrated a virtuous and patriotic terrorist, and I think there is much to be said in support V’s paradigm.

Now let me Amend and Supplement Barry’s statement (as well as the message of V-for-Vendetta the statement of the slaves at the end of Spartacus) by reminding you all of this: All my life I’ve heard that when guns are outlawed, only outlaws will have guns. A corollary of that is when Freedom is outlawed, only Outlaws will be free. So in the Spirit of ’76, I am announcing to the world that “If the Security of this Country against Terrorists Requires the Suspension of the Constitution, then I am on the side of Terrorists.” “Terrorists in support of Liberty are Virtuous Patriots, Moderates who Vote for Detention without Trial know neither Justice nor Virtue.” IF VOCALLY OPPOSING MY GOVERNMENT’S DESCENT INTO TOTALITARIAN DICTATORSHIP MEANS THAT I MIGHT BE CALLED A TERRORIST, THEN BY GOD, YOU MAY CALL ME A TERRORIST. IF HONORING and PERPETUATING THE CONSTITUTION WHICH I WAS BROUGHT UP TO REVERE SECOND ONLY TO THE BIBLE MAKES ME A TERRORIST, THEN BY GOD I SWEAR TO YOU THAT I AM A TERRORIST. So Come and get me!
